Ghanaian lawyer Kwasi Fokuo Benyin has raised alarm over what he described as an “extremely unusual” delay in issuing a written court order following the remand of political figure Kwame Baffoe Abronye.
Benyin said that five days after the ruling, the formal order had not been signed or made available, preventing Abronye’s lawyers from filing an appeal or pursuing further legal remedies.
“That is a very serious anomaly,” he said on theAsaase Breakfast Show on Tuesday (19 May).
He explained that without the written order, defence lawyers are effectively blocked from escalating the case to a higher court.
“The appellate system exists to correct judicial errors, but you cannot activate it without the order,” he added.
Benyin said the delay risks causing “substantial injustice” and undermines due process, particularly in criminal cases where urgency is paramount.
He urged that even if a judge believes a ruling is correct, the order must be released promptly to allow for review.
