The High Court has restrained the Economic and Organised Crime Office (EOCO) from maintaining a “wanted” notice against Dr. Gabriel Tanko Kwamigah-Atokple, the Council of State member for the Volta Region and directors of Sesi-Edem Company Limited, ordering the agency to halt further enforcement actions linked to the case.
The court also barred EOCO, its officers, and any agents acting on its behalf from arresting, detaining, inviting, charging, or otherwise interfering with the liberty of the company’s directors while the substantive matter remains before it.
The ruling stems from a dispute involving a gold supply contract with JG Resources Ltd, which had petitioned EOCO over alleged non-delivery of gold. Court filings, however, indicate the contract’s delivery deadline is June 2026.
EOCO had previously declared the company’s directors wanted on 30 March 2026, prompting legal action to challenge the move.
The High Court, exercising its supervisory jurisdiction, also cited earlier findings that EOCO had acted outside its statutory mandate, including freezing the company’s bank accounts on allegations of fraud and money laundering before the contractual deadline had elapsed.
In earlier proceedings, the court ordered the unfreezing of the company’s accounts and found no basis for the criminal allegations at that stage, according to court records referenced in the case.
The latest order directs EOCO to withdraw the wanted declaration pending determination of the substantive application, effectively halting enforcement steps tied to the disputed investigation.
