Deputy Attorney General, Justice Srem Sai has stated that the Oppong Nkrumah’s application for injunction on vacation courts was built on falsehood.
He says the applicants were aware that the warrant issued by the Chief Justice was not specific to just two cases but was general.
Making this point known in a social media post he said “The Plaintiff/Applicant and his lawyers built their case on the allegation that the Chief Justice has assigned some “selected cases” to two Judges to hear during the legal vacation. So, they applied for an injunction against the two Judges.
In court, however, their own evidence shows that their allegation was a deliberate falsehood. Their Exhibit D shows that the CJ’s warrant was general and not specific to any particular case. Worse is Exhibit E, which shows that as many as 29 Judges (not 2) are sitting during the legal vacation.
The point, however, is that they have succeeded in preventing the courts from working for one week. Never underestimate the power of deliberate falsehood.
Supreme Court has dismissed Kojo Oppong Nkrumah’s application seeking to injunct two vacation Courts (Specialised Court 1 and 2) from sitting pending the determination of his writ challenging the warrant given to these judges to sit during the legal vacation.
The court was presided over by Justice Gabriel Scot Pwamang (JSC).
The ruling paves way for the Specialized Court 1 to conduct hearings in Republic v Kwabena Adu Boahene and Republic v Hanan Abdul Wahab Aludiba & others scheduled for Tuesday, 25th August, 2026.
The Specialized Court 1 on Monday, August 17 agreed to submission of Counsel for the accused persons in Republic v Adu Boahene & 2 Ors and suspended hearings to wait for the outcome of this injunction application which had been filed at the Supreme Court.
With the injunction application dismissed, the Specialized Court 1 is expected to sit for cross examination of the 4th Prosecution Witness in Republic v Kwabena Adu Boahene & 2 Ors (Cybersecurity software case) and as well hear legal arguments on the effect of a stay of proceedings filed at the Court of Appeal in Republic v Hanan Abdul Wahab Aludiba & Another.
